Only 25% of councils are meeting self-build demand

Since 2016, 99,558 people have registered their interest in building their own home. But councils have only permitted 63,296 plots — leaving a national deficit of 36,262 plots.

What is the Self-Build Register?

The Self-build and Custom Housebuilding Act 2015 requires each council in England to keep a register of people who want to build or commission their own home. The council must give development permission for enough serviced plots to meet the demand on Part 1 of its register within three years of the end of each “base period” (each runs from 31 October to 30 October). Since 31 January 2024, demand not met in that time carries into a later base period.

Where a council sets local eligibility tests, the register has two parts. Part 1 holds people who meet every condition; Part 2 holds people who meet every condition except a local connection test. Only Part 1 entries count as demand for the duty to give permission.

What happens if a council doesn't meet its self-build duty?

The Act sets no penalty. A council's performance of the duty can be challenged by judicial review. In planning decisions, a shortfall is evidence that the need for self-build plots is not being met. At appeal, Inspectors have given the benefit of new self-build plots weight ranging from limited to substantial, depending on the shortfall, the number of plots and how they are secured as self-build. The weight is for the decision-maker in each case.

What counts as a serviced plot for self-build?

In the Self-build and Custom Housebuilding Act 2015, a serviced plot is a plot of land that has access to a public highway and connections for electricity, water and waste water, or that can be given them before any permission for it expires. It need not be a plot for a single home. A permission granted since 31 January 2024 counts towards a council's duty only if it is for the carrying out of self-build and custom housebuilding.

How long does a council have to meet the demand on its register?

Each base period runs from 31 October to 30 October. A council has three years after a base period ends to give permission for enough serviced plots to meet the Part 1 demand from that period. For example, demand added in the base period ending 30 October 2019 had to be met by 30 October 2022.
